Virginia rental application rules to know
- •Application fees are capped at $50 ($32 for HUD-regulated units), not counting the landlord's actual out-of-pocket cost for third-party screening (Code of Virginia § 55.1-1203). The fee itself is non-refundable.
- •An application deposit (separate from the fee) is refundable: if you're rejected, it must come back with an itemized statement within 20 days, or within 10 days if you paid by cash, certified check, cashier's check, or money order.
- •Security deposits are capped at two months' rent and must be returned within 45 days with an itemized statement (§ 55.1-1226).
- •Source of funds, including Section 8 vouchers, is protected statewide since 2020. Exceptions: landlords with 4 or fewer Virginia rental units, and vouchers not approved within 15 days of the request for tenancy approval.
- •Since July 1, 2026, landlords may not require disclosure of sealed arrests, charges, or convictions, and applications that ask about criminal history must say sealed records don't need to be disclosed. This form includes that notice.
- •Late fees are capped at the lesser of 10% of the monthly rent or 10% of the unpaid balance.
- •Protected classes also include elderliness, source of funds, sexual orientation, gender identity, and military status.
