Manitoba rental application rules to know
- •A Manitoba landlord cannot ask for a security deposit larger than one half of the first month's rent. If you have a pet, the landlord may charge an additional pet damage deposit of up to another half month, for a combined maximum of one month's rent. The deposit is held in trust until you move out, and rules are administered by the Residential Tenancies Branch (RTB).
- •If the landlord has no claim against your deposit, it must be returned within 14 days of the tenancy ending. If the landlord does make a claim, they must notify you and the deadline extends to 28 days.
- •Security deposits accrue interest at a rate set by the province for the length of the tenancy, and that interest is paid back to you together with the deposit.
- •The 2026 rent increase guideline is 1.8%, though some units are exempt, such as buildings first occupied after 2005 (for their first 20 years) and high-rent units. A landlord who wants to raise rent above the guideline must apply to the Residential Tenancies Branch, and tenants must get at least 3 months of written notice before any increase takes effect.
- •Under the Manitoba Human Rights Code, a landlord cannot refuse you or change your terms because of your source of income, such as social assistance, or the newer ground of social disadvantage, along with family status, disability and other protected characteristics.
- •You can be asked for your Social Insurance Number, but you do not have to provide it. The federal Privacy Commissioner advises against sharing it, and a basic credit check needs only your name, date of birth and address.
- •Manitoba is unusual in that its Human Rights Commission accepts discrimination complaints based on criminal record, mainly as an analogous ground under Code s. 9(1)(a) (a Commission policy since 2020) and secondarily through social disadvantage analysis, so questions about criminal history carry more legal risk here than in most provinces.
