Ohio rental application rules to know
- •Ohio has no cap on application fees ($30 to $75 is typical) and no receipt or refund statute. Ask what the fee covers before paying.
- •There is no security deposit cap. Deposits must be returned within 30 days of move-out with written itemized deductions (ORC § 5321.16).
- •Wrongfully withheld deposit amounts are recoverable at double, plus attorney's fees, provided you gave the landlord a written forwarding address.
- •If your deposit exceeds $50 or one month's rent (whichever is greater) and you stay 6+ months, the excess earns 5% annual interest.
- •Ohio has no statewide source-of-income protection, but 20+ cities protect voucher holders locally, including Columbus, Cincinnati, Toledo, Dayton, and Akron.
- •Statewide protected classes are the federal seven plus military status and ancestry, and landlords may not ask questions probing any protected class (ORC § 4112.02(H)).
- •Criminal-history screening is lawful statewide, subject to federal FCRA consent and adverse-action rules.

Frequently asked questions
Is there a limit on rental application fees in Ohio?
No. Ohio sets no cap, and fees (typically $30 to $75) are generally non-refundable with no receipt requirement. It's fair to ask a landlord what screening the fee actually pays for.
When do I get my security deposit back in Ohio?
Within 30 days of moving out, with written itemized deductions. If the landlord wrongfully withholds, ORC § 5321.16 lets you recover double the wrongfully withheld amount plus attorney's fees, provided you gave the landlord a written forwarding address.
Does my Ohio deposit earn interest?
Sometimes. If the deposit exceeds $50 or one month's rent (whichever is greater) and you stay at least 6 months, the excess earns 5% annual interest.
Can Ohio landlords refuse Section 8?
Under state law yes, but more than 20 Ohio cities ban source-of-income discrimination locally, including Columbus, Cincinnati, Toledo, Dayton, and Akron. Check your city's ordinance.
Can Ohio landlords ask about criminal history?
Yes, statewide. Federal rules still apply: written consent for background checks and adverse-action notices if a report leads to denial. Blanket bans can still create fair-housing disparate-impact liability.
