Quebec rental application rules to know
- •All rental deposits are prohibited in Quebec. Civil Code of Quebec s. 1904 bars a landlord from demanding any security, damage, key, or pet deposit, and lets them collect at most the first month's rent in advance.
- •There are no legal application, screening, or credit-check fees in Quebec. A landlord can run checks but cannot charge you to apply or to be screened.
- •A landlord cannot require postdated cheques or any other postdated payment instrument, and cannot demand rent in advance for more than the first payment period (Civil Code s. 1904).
- •A residential lease in Quebec can be verbal, but if it is put in writing it must use the mandatory lease form of the Tribunal administratif du logement (TAL), required for new written leases since 1996. For a verbal lease, the landlord must give you the mandatory clauses in writing within 10 days. A landlord who skips the form can face penalties, and you keep all your legal rights regardless.
- •The Charter of human rights and freedoms s. 10 and s. 12 bars a landlord from refusing you a lease because of race, colour, sex, pregnancy, gender identity, sexual orientation, civil status, age, religion, political convictions, language, ethnic or national origin, disability, or social condition (such as income, occupation, or receiving social assistance). Separately, Civil Code of Quebec art. 1899 bars a landlord from refusing to rent to you because you have children.
- •A landlord may verify that you can pay, but only needs your full name, address, and date of birth to run a credit check. You are not required to give your Social Insurance Number.
- •Under Quebec's private-sector privacy law, a landlord may collect only the personal information necessary to decide on the lease. If you are asked for more, you can decline and complain to the Commission d'acces a l'information or the TAL.

Can a Quebec landlord ask for a security or damage deposit?
No. Civil Code s. 1904 prohibits every kind of deposit, including security, damage, key, and pet deposits. The most a landlord can collect up front is your first month's rent, and they cannot make the lease conditional on paying anything extra.
Are rental application fees legal in Quebec?
No. A landlord cannot charge you a fee to submit an application or to have your credit, references, or income checked. If you are asked to pay one, you can refuse and raise it with the Tribunal administratif du logement (TAL).
Do I have to use the TAL lease form?
The lease itself must be on the mandatory TAL form, which landlords have been required to use for new residential leases since 1996. A rental application is a separate document you complete before the lease, and this free form covers the standard details a landlord asks for at that stage.
Do I have to give my Social Insurance Number to rent in Quebec?
No. A landlord only needs your full name, address, and date of birth to run a credit check. Providing your SIN is optional and cannot be forced as a condition of renting.
Can a landlord refuse me because I am a student or on social assistance?
No. Social condition, which includes your income, occupation, and receiving social assistance, is a protected ground under the Charter of human rights and freedoms s. 10. Refusing a lease on that basis is discrimination you can report to the Commission des droits de la personne.
Can a landlord require postdated cheques?
No. Civil Code s. 1904 specifically prohibits a landlord from demanding payment by postdated cheque or any other postdated instrument. You choose how to pay your rent within what the lease reasonably provides.
