Hawaii rental application rules to know
- •Security deposit cap: a landlord may not require more than one month's rent as a security deposit (HRS § 521-44). If pets are allowed, the landlord may collect an additional pet deposit of up to one month's rent, but not for a service or assistance animal.
- •Deposit return: the landlord must return your deposit, with an itemized statement of any deductions, within 14 days after the rental agreement ends and you move out (HRS § 521-44).
- •Wrongful withholding: if a landlord keeps your deposit in bad faith, a court can award you up to three times the amount wrongfully withheld (HRS § 521-44).
- •Screening fee: under Act 200 (effective May 1, 2024, HRS § 521-46), a tenant screening fee cannot exceed the landlord's actual cost of obtaining your credit report, background check, and references. There is no fixed dollar cap.
- •Fee refund and receipt: a landlord must refund any part of the fee not used for screening within 30 days of submitting the request, and must give you a receipt and cost breakdown on request. Only applicants 18 or older, or emancipated minors, can be charged (HRS § 521-46).
- •Source of income: since May 1, 2023, a landlord who owns more than four rental units may not refuse you, set different terms, or advertise against you because you use a Section 8 voucher or permanent supportive housing assistance (HRS § 368F-2, Act 310, SLH 2022).
- •Extra protected classes: Hawaii's fair housing law also bars discrimination based on sexual orientation, gender identity or expression, marital status, age, ancestry, and HIV infection, on top of the federal categories (HRS § 515-3).
- •Criminal history: Hawaii has no statewide law limiting criminal-history questions on rental applications, but a blanket ban on anyone with a record can still create Fair Housing Act disparate-impact liability.
