How much can a landlord charge for a security deposit in Hawaii?

No more than one month's rent (HRS § 521-44). If pets are allowed, the landlord may collect an additional pet deposit of up to one month's rent, but cannot charge a pet deposit for a service or assistance animal.

How long does a Hawaii landlord have to return my deposit?

14 days after your tenancy ends and you move out. The landlord must include an itemized list of any deductions. If they withhold money in bad faith, you may recover up to three times the amount (HRS § 521-44).

Can a landlord charge me an application or screening fee?

Yes, but only up to the actual cost of obtaining your credit report, background check, and references (HRS § 521-46). There is no set dollar cap, and any unused portion must be refunded within 30 days of the request.

Can a landlord in Hawaii reject me for using a Section 8 voucher?

Landlords who own more than four rental units cannot refuse you, set different terms, or advertise against tenants using Section 8 or permanent supportive housing assistance (HRS § 368F-2). Smaller landlords may be exempt.

Does this form ask about criminal history?

Yes. Hawaii does not restrict criminal-history questions on rental applications. Landlords should still avoid automatic, blanket rejections, which can raise fair-housing concerns.

Do I have to pay a separate fee for each person on the application?

A screening fee can only be charged to applicants who are 18 or older or emancipated minors, so you should not be charged for minor children (HRS § 521-46).
