What is the maximum security deposit in Alabama?

Generally one month's rent under Ala. Code § 35-9A-201. A landlord can add to that only for a pet deposit, for alterations you want to make, or for activities that raise the landlord's liability or the property's hazard, such as certain business uses.

When do I get my security deposit back in Alabama?

Within 60 days after your tenancy ends and you return the keys. The landlord must send an itemized list of any deductions. Missing that deadline or withholding in bad faith makes the landlord liable for double the amount of your original deposit.

How much can an Alabama landlord charge to apply?

There is no cap on application fees in Alabama, and they are usually nonrefundable. Ask what the fee covers and whether each adult is charged separately before you pay.

Does this application ask about criminal history?

Yes. Alabama has no statewide fair-chance housing law and no major local ordinance limiting criminal-history questions on private rental applications. A landlord still cannot apply a blanket ban in a way that creates Fair Housing Act disparate-impact liability.

Can an Alabama landlord refuse a Section 8 voucher?

Yes. Alabama does not protect source of income, so a private landlord can decline to accept a Housing Choice Voucher.

Are late fees capped in Alabama?

There is no statutory cap. A late fee is enforceable only if it is written into your lease and is a reasonable amount, generally understood to mean it should reflect the landlord's real cost rather than a penalty.
